Anti-Spam Policy

Paladin Coaching, Inc. (“Paladin”) prohibits the use of their website and/or services in any manner associated with the transmission, distribution or delivery of any unsolicited bulk or unsolicited commercial e-mail (“Spam”). You may not use any Paladin services to send Spam. You also may not deliver Spam or cause Spam to be delivered to any customers of Paladin.

In compliance with the CAN-SPAM Act of 2003 (15 U.S.C. 7701, et seq., Public Law No. 108-187, was S.877 of the 108th United States Congress), e-mail sent, or caused to be sent, to or through the Paladin website or service may not:

•    use or contain invalid or forged headers;
•    use or contain invalid or non-existent domain names;
•    employ any technique to otherwise misrepresent, hide or obscure any information in identifying the point of origin or the transmission path;
•    use other means of deceptive addressing;
•    use a third party’s internet domain name, or be relayed from or through a third party’s equipment, without permission of the third party;
•    contain false or misleading information in the subject line or otherwise contain false or misleading content;
•    fail to comply with additional technical standards described below;
•    otherwise violate our Terms of Use.

Paladin does not authorize the harvesting, mining or collection of e-mail addresses or other information from or through the website or its services. Paladin does not permit or authorize others to use the Paladin services to collect, compile or obtain any information about its customers or subscribers, including but not limited to subscriber e-mail addresses.

Paladin does not permit or authorize any attempt to use its services in a manner that could damage, disable, overburden or impair any aspect of any of the services, or that could interfere with any other party’s use and enjoyment of any Paladin service.

If Paladin believes that unauthorized or improper use is being made of any service, it may, without notice, take such action as it, in its sole discretion, deems appropriate, including blocking messages from a particular internet domain, mail server or IP address. Paladin may immediately terminate any account on any service which it determines, in its sole discretion, is transmitting or is otherwise connected with any e-mail that violates this policy.

Nothing in this policy is intended to grant any right to transmit or send e-mail to, or through, the Paladin website and/or services. Failure to enforce this policy in every instance does not amount to a waiver of Paladin’s rights.

Unauthorized use of any Paladin services in connection with the transmission of unsolicited e-mail, including the transmission of e-mail in violation of this policy, may result in civil, criminal, or administrative penalties against the sender and those assisting the sender.

Violators of the CAN SPAM Act may be subject to “cease and desist” orders or penalties from the FTC (Federal Trade Commission) of up to $11,000 per violation. Criminal prosecution is also possible in the case of egregious offenders, which can result in penalties such as fines, forfeiture of proceeds and equipment. The worst offenders can also be subject to prison time.

E-Mail Policy

We are committed to keeping your e-mail address confidential. We do not sell, rent, or lease our subscription lists to third parties, and we will not provide your personal information to any third party individual, government agency, or company at any time unless compelled to do so by law.

We will use your e-mail address solely to provide timely information about Paladin Coaching, Inc. (“Paladin”).

Paladin will maintain the information you send via e-mail in accordance with applicable federal law.

CAN-SPAM Compliance

In compliance with the CAN-SPAM Act, all e-mail sent from our organization will clearly state who the e-mail is from and provide clear information on how to contact the sender. In addition, all e-mail messages will also contain concise information on how to remove yourself from our mailing list so that you receive no further e-mail communication from us.

Choice/Opt-Out

Our site provides users the opportunity to opt-out of receiving communications from us and our partners by reading the unsubscribe instructions located at the bottom of any e-mail they receive from us at any time.

Users who no longer wish to receive our newsletter or promotional materials may opt-out of receiving these communications by clicking on the unsubscribe link in the e-mail or e-mail us at ask@paladincoaching.com.

Privacy Policy

Paladin Coaching, Inc (“Paladin”) provides you with this privacy policy (“Privacy Policy”) to let you know PALADIN’s information collection and usage policies and practices that apply to information collected on the PALADIN website at PALADINCOACHING.COM (the “Site”). By using the Site, you agree to the terms of this Privacy Policy and agree to be bound by the Site’s Terms and Conditions, available here. If you do not agree with this Privacy Policy or the Terms of Use, you should discontinue your use of the Site.

Information Collection: When you visit the Site, PALADIN collects information about you and your browsing habits. The information we collect depends on the pages of our website you visit and what you do during your visit.

PALADIN may collect information from you automatically when you visit our website, which may include the name of the domain and host from which you access the Internet; the Internet protocol (IP) address of your computer; the type of browser and software operating system you use; web log data, including the date and time you access our website; and the Internet address of the website from which you linked to our site.

Several companies offer tools that allow people to browse the web anonymously. We cannot provide you a personalized experience if you use these tools, because we cannot recognize you and your computer. However, we want to ensure you know of their existence. Because PALADIN does not track your online activities over time and across third party websites in order to provide targeted advertising, PALADIN does not respond to Do Not Track (DNT) signals.

PALADIN may also use cookies to enhance browsing on our website. “Cookies” are small files or records that are placed on your computer’s hard drive to collect information about your activities on our website. You can choose to have your browser warn you every time a cookie is being sent to you, and you can turn off cookie placement. If you refuse, your overall browsing experience can be affected and may prevent you from fully using the Site. To learn more about cookies, visit www.allaboutcookies.org. PALADIN may also use “message format” and “message open” sensing technologies to enable PALADIN to recognize whether you have enabled your email program to receive HTML emails. If so, this information is associated with your email address so that we can send subsequent messages to you in HTML format. The “message open” sensing technology allows us to recognize whether you have opened our email messages. We can only detect this if you have enabled your email program to receive HTML emails.

For most of the browsing services on the Site, PALADIN does not require your personal information. There are portions of the Site where you will be given the option to provide information about you. The information that you may be asked to provide may include your name, email address, telephone number, and address. Depending on your request and other circumstances, other information may also be collected. It is your discretion and determination whether to provide such information.

Use of the Information: PALADIN uses the information it collects (whether submitted by you or automatically collected) to respond to your requests, to provide you with information that PALADIN thinks may be of interest to you, and to operate its business. PALADIN may also disclose your information to its affiliates, agents, and third-party vendors and service providers working on our behalf. Further, PALADIN may disclose information provided by you as part of any merger, sale, acquisition, or other acquisition of same or all of PALADIN or its assets.

Your Choices: PALADIN does not require you to provide personal information in order to use the Site. However, if you choose to not provide requested personal information, your ability to use all of the Site’s features may be limited or you may not receive the information that you are requesting. Underage Customers: This Site is not designed nor intended to collect information from children under the age of 13. In addition, PALADIN does not knowingly collect information from children under the age of 13.

PALADIN markets our products and services exclusively to adults. If you are younger than age 18, you may use our website only with the permission and involvement of your parents or guardian.

Links to Third-Party Websites: When you click on links on the Site that take you to third-party website(s), you will be subject to the third parties’ privacy policies. PALADIN cannot and does not accept responsibility for the content or actions of any third-party website(s). We encourage you to read the posted privacy statement of every site you visit, whether you are linking from our site or browsing on your own. When you visit the Site or other third-party websites via links on the Site, depending on your browser settings and/or configurations and/or the sites you visit, some third-party sites may collect information about your online activities and browsing habits. We reserve the right to modify or amend this policy at any time by posting the revised Privacy Policy on our Site. If we modify, amend, or otherwise revise this policy, we will revise the date. This Privacy Policy is effective as of the most recent date it was amended. We encourage you to periodically review this Privacy Policy for the latest information on our privacy practices.

Governing Law: This Privacy Policy is governed by the laws of the State of New Hampshire without giving effect to any principles of conflict of law. All claims arising out of or relating to this Privacy Policy or the Site’s Terms of Use will be litigated exclusively in the federal or state courts of Cheshire County, New Hampshire, USA, and you and PALADIN consent to personal jurisdiction in those courts.
